Kompare.co.uk is an online insurance intermediary and through our website we offer both online and offline comparison services in relation to a number of financial and insurance products and services.

Kompare.co.uk is owned and operated by Kompare Limited (referred to in these terms and conditions as Kompare, we or us), who are registered in England and Wales (Company number 10839922) and our registered address is Northside House Mount Pleasant, Barnet, EN4 9EE (the “Company”).

We are an insurance intermediary authorised and regulated by the Financial Conduct Authority for insurance mediation activity (Firm Reference Number 794660). We provide a service that enables you to compare a number of online or offline prices for products and services. We do not provide financial or other advice in relation to the products or services compared, nor do we provide a recommendation or endorsement. We will ask you some questions and the results produced will be based on your answers. This will enable you to make an informed decision on which policy or product best suits your need before proceeding to your chosen provider for further information.

Ownership

Kompare Limited has similar ownership connections to Rainbow Connected Limited and Rainbow (UK) Limited. This has no impact on how Kompare is operated or controlled as the companies are completely separate businesses. Since the success of Kompare is based on impartial comparison for our consumers, we do not favour the Rainbow Connected or Rainbow (UK) brand on any of our services. We list online comparison results based on factors such as price and policy features. For offline comparison results we place you with insurers from our panel of insurance partners whose criteria you match in order to receive a competitive quote.

How we are paid

You will not be charged for using our website. Instead, when you use our website to buy a product or service from a third party, that third party pays a commission to us.

We will not vary any terms and conditions which you previously agreed whilst using this website. However, any amended Terms and Conditions will apply to your use of the website from the date they are posted and if you do not agree with the amended Terms and Conditions, you are entitled to stop using this website at the time.

2.2 “we” “us” and “our” means Kompare.co.uk and its owner Kompare Compare Limited.

2.5 “quote” means a price provided by a product or service provider for comparison with other quotes on the basis of the information you have provided. In providing you with a quote we are not able to guarantee the availability of the product, the service or the price set out as you will need to deal with the product or service provider direct to make a purchase

3. Use of our website

3.1 By using our website you agree that:

3.1.1 You will not do anything that affects the integrity or security of this website or causes or may cause harm, damage or unreasonable inconvenience to the other users of this website or us; and

3.1.2 You will not gather, extract, download, reproduce and/or display or advertise on any other website, other online or offline service or otherwise, any material on or from this website, including but not limited to information relating to insurance prices, whether that information has been gained by use of spiders, data mining, trawling or other ‘screen scraping’ software or system used to extract data

3.1.2 If you breach any of the clauses set out at 3.1 above, we may take such action as we deem appropriate, including denying you access to this website, bringing legal proceedings against you and disclosing such information to appropriate legal and/or regulatory bodies.

3.2 When you use our website, we provide a functionality whereby you can access software, which provides you with quotations (the “Software”). The Software is licensed to the Company, and the Company sub-licenses to you only for the purposes of obtaining a quote for insurance that you require. Nothing in these Terms and Conditions gives you any ownership rights in the Software. In no circumstances shall you transfer, copy, reverse assemble, decompile the Software, or attempt to do any of these things. You hereby indemnify and hold us harmless against any breach of this clause 3.2.

4. UK residents only

4.1 This website is directed only at UK residents and nothing within it or these Terms and Conditions constitutes an offer or promotion of service or product to persons outside the United Kingdom. We do not make any warranty or representation that the services we offer are available or appropriate for use by those outside the UK. Should you choose to use the services we provide outside the UK, you do so at your own risk and it is your responsibility to ensure that you are compliant with any applicable local laws.

5. Your responsibilities

Insurance obligations

5.1 We will provide you with quotations based on the information you have provided to us. Where we ask questions to help source quotations, you are responsible for:

5.2 In order to accept a quotation provided by us you will need to link to the underlying product or service provider website and retrieve your details or, where applicable, contact them by phone.

5.3 Before purchasing a policy it is extremely important that all the information the product or service provider holds on you is accurate. You should therefore ensure that all information you provide to us is complete and accurate. Neither we nor any product or service providers will check this information for you. Again, failure to do this may lead to your insurance being invalid or an increase in the cost of that policy.

5.4 It is important that you read the product or service provider’s terms and conditions to check that you understand and agree with them. The product or service provider’s terms and conditions are not the same as ours and they will be the terms you agree to when you accept a quotation.

5.5 It is important that you read all insurance documents issued to you and ensure that you are aware of the cover, limits and other terms that apply. Failure to comply with the product or service provider’s terms and conditions could invalidate your policy.

5.6. You should also check that all your details on the policy documents are correct, including any assumptions that may have been made on your behalf by the product or service provider, it is your responsibility to notify the product or service provider. Failure to inform the product or service provider of any errors or missing information could invalidate your policy.

Other obligations

5.7 You must keep your password confidential and it must not be disclosed to or shared with anyone. You are solely responsible for all use of your account on our website.

5.8 Where you provide information about any other individual (e.g. named driver) you are confirming to us that you have their authority to do so.

5.9 You must not misuse our website by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain authorised access to our website, the server on which our website is stored, or any server, computer or database connected to it.

6. Our responsibilities

We are responsible to you for:

6.1 any losses you suffer to the extent that they have been caused by errors in our price comparison technology; and

6.2 any claim you may have against us for a personal injury or in respect of your death if caused by our negligence; and

6.3 any statements made by our employees to you which are not true statements of fact and which are made by that employee with fraudulent intent; and

6.4 any statements made by our employees to you which are misleading or untrue.

6.5 Except in the case of (6.2) or (6.3) above (where liability to you is unlimited), our liability to you will be limited to the upper level of our insurance limit which may vary from time to time.

We are not responsible to you for:

6.6 Any reliance that you may place on any material or commentary posted on our website. Please note that nothing contained in our website or the material published on it is intended to amount to advice on which you should rely; or

6.7 any losses you suffer because the information you put into our website is inaccurate or incomplete; or

6.8 any losses you suffer if the information you put into our website is accurate but the product or service provider’s website has not accurately reflected that information because its system is not working correctly; or

6.9 any losses you suffer if you misrepresent any fact which may influence the product or service provider’s decision to accept the risk or the term offered; or

6.10 any losses you suffer because you cannot use our website at any time; or

6.11 any losses you suffer through connecting to any linked third party websites or any statements, information, content, products or services that are published on, or may be accessible from, any linked third party website and we do not guarantee that they are free from viruses or anything else that could be infectious or destructive; or

6.12 any errors in or omissions from our website; or

6.13 any losses you may suffer by relying on any commentary, postings or reviews (of our services or that of our partners) on our website; or

6.14 any losses or damage caused by a distributed denial-of-service attack, viruses r other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any material posted on it, or on any website linked to it; or

7. Validity of online quote

7.1 We do not control the price, length of offers, or special conditions relating to price comparison quotes, these are set by product or service providers. If you obtain a quote and would like to see how long it is valid for or any special conditions relating to it, please click through the links contained on our website to the product or service provider’s website. Product or service providers’ prices, rates and offer times are updated and amended on a regular basis so our price comparisons are subject to change

7.2 In order to purchase any of the products or services described on our website you must contact the product or service provider. When a price is shown on this website you will also find a direct link to the product or service provider’s website. For some products or services you may need to or choose to complete your transaction over the telephone. The product and contact details of the product or service provider are listed on their website.

8. Delivery of online quotes

8.1 You should receive the results of our price comparison via the Software. However, we rely on the availability of third party sites and general performance of the worldwide web. At certain times some or all online quotes may not be available to you due to problems with third party websites or the worldwide web. Wherever possible, we will try to notify you of this.

8.2 Whilst we strive to provide as comprehensive and easy to use a service as possible, the requirements for your quote may not be met if such requirements are unusual, “non standard” or “high risk”. If this is the case you should contact a provider directly to discuss your requirements

8.3 All prices quoted are inclusive of Insurance Premium Tax (IPT) where applicable. This is a levy on insurance premiums set by the UK Government. The amount charged by insurers could change if IPT rates are amended by the Government at short notice.

9. Delivery of offline quotes

9.1 In the event of a product or service not live for online price comparison, your details are sent to the product or service providers whose criteria you match, who will contact you directly, in order for you to obtain a competitive quote. Your details may be sent to no more than 5 product or service providers.

9.2 All prices quoted are inclusive of Insurance Premium Tax (IPT) where applicable. This is a levy on insurance premiums set by the UK Government. The amount charged by insurers could change if IPT rates are amended by the Government at short notice.

10. Intellectual property

10.1 All Information, data and copyright material contained on this website and the Software, including any trade marks (whether officially registered or unregistered), trade names, brands, logos and devices belong to us or to people whom we have given ownership or permission to use such as information data and/or copyright material. You must not use such information or copyright material unless you have written permission from us or the owner to do so.

10.2 You may download or copy the content and other downloadable items displayed on this website for personal non business use only, (i.e. to assist with a purchasing decision) provided that you ae not otherwise breaching these Terms and Conditions.
